Neese and Beatrice M. Neese, Trustees of the Richard H. Neese and Beatrice M. Neese Revocable Trust, under Declaration of Trust dated November 6, 1992, for the acquisition of rights of way needed for construction of the Ackerman Creek Bridge on North State Street, County Road 104, milepost 0.97, Project Number A-1101 (Ukiah Area); and authorize Chair to sign same.

By Resolution Number (No.) 11-093 (June 14, 2011), Board of Supervisors (BOS) approved BOS Agreement No. 11-056/Department of Transportation (DOT) Agreement No. 110022 with Quincy Engineering, Inc., for civil engineering, geotechnical, and environmental services; by Resolution No. 16-016 (February 9, 2016), BOS approved an initial study/mitigated negative declaration and mitigation monitoring and reporting program for this project under the California Environmental Quality Act requirements; by Resolution Nos. 17-183 and 17-184 (December 5, 2017), BOS approved BOS Agreement Nos. 17-146 and 17-147/DOT Agreement Nos. 170048 and 170065, and accepting the Grant Deeds from other landowners to acquire the necessary right of way for DOT Project No. A-1101.
Summary of Request:
Rights of way are needed for the above-referenced project for the removal and replacement of the existing bridge over Ackerman Creek and to realign the roadway approaches located on North State Street, County Road 104 at milepost 0.97. Erickson Brothers Properties, LLC and Richard H. Neese and Beatrice M. Neese, Trustees of the Richard H. Neese and Beatrice M. Neese Revocable Trust, under Declaration of Trust dated November 6, 1992, own the property that the County needs to acquire and have signed DOT Agreement No. 190042 and the Grant Deed, in accordance with the terms set forth in said agreement, whereby they agree to convey to the County the said rights of way needed. DOT is now requesting the Board approve DOT Agreement No. 190042 and accept the Grant Deed for the conveyance of real property to the County from Erickson Brothers Properties, LLC and Richard H. Neese and Beatrice M. Neese, Trustees of the Richard H. Neese and Beatrice M. Neese Revocable Trust, under Declaration of Trust dated November 6, 1992
