Summary of Request:
The Lanterman-Petris -Short (LPS) Act is the California law governing the involuntary civil commitment of individuals who, due to mental illness, pose a danger to themselves, a danger to others, or who are gravely disabled and require inpatient psychiatric care. The intent of the LPS Act was to end inappropriate lifetime commitment of people with mental illness and firmly establish their right to due process, while significantly reducing state institutional expense.
Pursuant to the requirements of the LPS Act, Mendocino County is responsible for providing residential care services to LPS clients who are court-mandated to receive a specific level of care requiring a structured environment due to mental health challenges. Currently, there are no local facilities in Mendocino County that are able to provide all levels of care as mandated by the courts. In addition, there is a shortage of residential care facilities statewide, which creates competition for these placements. As a result, the Health and Human Services Agency (HHSA), Behavioral Health and Recovery Services (BHRS) contracts with multiple residential care facilities in order to help manage the shortage and maintain current client placements, ensuring the most appropriate care within the largest possible placement options.
Helios Health Care, LLC. is one of a few residential care facilities able to provide services to Mendocino County clients. Helios Health Care, located in Sunnyvale, CA, is a Skilled Nursing Facility providing a broad range of services for adult clients, including psychological rehabilitation support, activities and educational opportunities to improve life skills, treatment by a psychiatrist, and provision of healthcare needs. Through this contract, Helios Health Care will provide medical, nursing and rehabilitative services to BHRS clients over the age of 18 with neurological disorders, requiring a longer treatment phase to gain skills needed for community re-entry.
BHRS has not placed LPS clients at the Helios Health Care facility for several years, therefore did not enter into a contract with Helios in the beginning of Fiscal Year 2019-20. On November 23, 2019, BHRS was required to place a client at Helios Health Care after a search for alternate placement space under existing contracts was unsuccessful. Helios Health Care is under the same management as Crestwood Behavioral Health, and the placement at Helios was made under the assumption that it would be covered under the contract with Crestwood. Due to separate licensing requirements, Mendocino County BHRS must now establish a separate contract with Helios Health Care for placements at the Helios facility, necessitating a retroactive start date for this contract.
