Adopt Resolution authorizing the Health and Human Services Agency (HHSA) to enter into retroactive Agreement No. 19-5048 with the California Department of Social Services in the amount of $0 to provide HHSA Family & Children’s Services with legal consultation and legal representation in administrative action appeals associated with the Resource Family Approval program for the term of July 1, 2019 through June 30, 2021; and authorize Chair to sign same; and authorize the HHSA Director or designee to sign any future amendments that do not increase the maximum amount.

Summary of Request

Since 2017, California Department of Social Services (CDSS) has provided counties with legal consultation and legal representation in administrative action appeals associated with the state mandated Resource Family Approval program. These services are provided at no cost to counties when a county has deemed it necessary to deny approval or rescind approval of a Resource Family from being a foster care provider.

 

On February 14, 2020, Mendocino County, Health and Human Services Agency (HHSA), Family and Children’s Services (FCS) received a letter from CDSS requesting the execution of Agreement No. 19-5048 for legal services for fiscal years 19-20 and 20-21. HHSA therefore requests retroactive approval of the Agreement.
