Summary of Request

On September 12, 2020, the Governing Board of the Westport County Water District (“District”) adopted a resolution requesting the Mendocino County Board of Supervisors (“Board”) to approve consolidation of the District’s election of their governing board with the statewide General Election in November of each even-numbered year.  All districts located in Mendocino County were sent notices in accordance with Elections Code section 10404(c).  In accordance with Elections Code section 10404(d), the Clerk-Recorder/Registrar of Voters provided an impact analysis.  Elections Code section 10404(e) requires the Board to approve the District’s resolution unless it finds that the ballot style, voting equipment, or computer capacity is such that additional elections or materials cannot be handled. As reflected in the impact analysis, no evidence exists to support such a finding at this time.  It is worth noting that the County believes that certain facts stated in the District’s resolution may not be accurate, such as the dates of elections upon district formation, the dates on which their elections are currently scheduled, and the effective month of expiration of the officer’s terms of office.  Nonetheless, these mistakes do not impact the essence of the District’s resolution, which is to consolidate their elections with the statewide general election during even-numbered years, and to carry those elections and resultant terms of offices out in accord with the elections code.
