Summary of Request

At the direction of the Board of Supervisors, County Counsel in coordination with the Public Health Branch of the Health and Human Services Agency, submits the proposed repeal and replace of Chapter 6.20 of the County Code regarding licensure of tobacco retailers. The proposed changes were requested by the Board of Supervisors to: ensure consistency with recently amended state laws; revise the definition of Tobacco Product to include Electronic Nicotine Delivery Systems (ENDS), and prohibit the sale of Flavored Tobacco Products, which appeal to youth and make it easier for them to begin using tobacco products. Additionally, changes were made to clarify the grounds for suspension, termination and revocation of licenses, administrative fines for violating tobacco-related laws, and appeal procedures. The Tobacco Retail License Program is funded by the fees collected from licensing and compliance surveys.
