PREVIOUS BOARD/BOARD COMMITTEE ACTIONS:
December 7, 2004: Original Ordinance No. 4135 adopted (provided for licensure and education of tobacco merchants); August 26, 2008: Ordinance amended to address the hearing process and penalties; October 6, 2020: Direct County Counsel to prepare an update to the Tobacco Retail License Ordinance, Chapter 6.20 Licensure of Tobacco Retailers.

SUMMARY OF REQUEST:
At the direction of the Board of Supervisors, County Counsel in coordination with the Public Health Branch of the Health and Human Services Agency, submits the proposed repeal and replace of Chapter 6.20 of the County Code regarding licensure of tobacco retailers. The proposed changes were requested by the Board of Supervisors to: ensure consistency with recently amended state laws; revise the definition of Tobacco Product to include Electronic Nicotine Delivery Systems (ENDS), and prohibit the sale of Flavored Tobacco Products, which appeal to youth and make it easier for them to begin using tobacco products. Additionally, changes were made to clarify the grounds for suspension, termination and revocation of licenses, administrative fines for violating tobacco-related laws, and appeal procedures.
