Adopt ordinance amending sections 18.16.070 and 18.16.080 of the Mendocino County Code regarding naming and renaming of private roads.

Previous Board/Board Committee Actions:
On May 7, 2019, the Board of Supervisors referred the “Road Naming Issues and Proposal” to the Fire and EMS Services Ad Hoc Committee. On December 15, 2020 the Ordinance was introduced and the first reading was waived.
Summary of Request:
The Fire and EMS Services Ad Hoc Committee met and discussed with staff from the Department of Planning and Building Services and the County Counsel’s Office various options to streamline the County’s current ordinance sections regarding the naming of private roads. The primary goal was to create a system that would allow for public safety agencies to submit road name proposals in a more efficient manner than provided for under existing ordinance sections.
After researching the issue, County staff proposed ordinance revisions that delegate the naming of private roads to the Director of Planning and Building Services. As outlined in the proposed ordinance, road name proposals may be commenced by the County, property owners along a road, or public safety agencies (specifically defined in the ordinance, but generally fire protection and law enforcement entities). The proposal is reviewed by the Address Coordinator and then interested entities are notified of the proposal and asked to submit written comments. Following the comment period, the Director makes a determination on the proposed road name, which determination may be appealed to the Board of Supervisors.
The primary purpose of creating an administrative procedure is to more quickly process road name change proposals. In the event of a controversial proposal, an appeal to the Board of Supervisors will provide the opportunity to speak to the County’s elected officials.
Additional changes to the procedures are lowering the threshold of property owner support for proposals brought by property owners from 75% to 60%.
Alternative Action/Motion:
Provide direction to staff.
