Summary of Request:
The Public Defender requests approval pursuant to Mendocino County Policy #25 to submit an application for a grant pursuant to the Indigent Defense Program that is administered by the Board of State and Community Corrections (BSCC). The Grand Administration Guide is attached to this Agenda Summary.
When and if approval is granted, the Public Defender will submit in the future a request to be permitted to sign the grant agreement. This request will be properly noticed before the Board, placed on the Agenda, and will include the formal grant proposal, as well as all relevant documents.
The Public Defender has worked with the California Public Defenders’ Association, the Office of the State Public Defender, and the BSCC to obtain a portion of funds that were set aside by California in the State Budget Act of 2020 (Senate Bill 74) for 19 small and rural counties in the state. The intention of Indigent Defense Grant Program is to address the staffing, training, case management needs, or other attorney support of Public Defender Offices. Each Public Defender office will need to develop a Project Work Plan that identifies measurable project goals, objectives, and commensurate timelines. There is no matching requirement and supplanting (i.e., appropriating grant funds for existing departmental purposes) is prohibited. The Indigent Defense Grant Program “shall be used to support new program activities or to augment or expand existing program activities but shall not be used to replace existing funds.”
The grant period is from February 15, 2021, to June 30, 2023. The amount available to Mendocino County is a total of $416,500 with $323,400 designated for the Public Defender and $93,100 for the Alternate Public Defender.
There is no fiscal impact or obligation on the part of Mendocino County that would be incurred as a result of the filing of the application, or, indeed, upon the awarding of grant funds.
