Recommended Action/Motion:

recommendation

Provide direction to Counsel and Behavioral Health regarding the draft Ordinance Adding Chapter 2.8 - Terms of Members Appointed to Boards and Commissions to the Mendocino County Code.

Previous Board/Board Committee Actions:

On August 1, 2017, the Board of Supervisors passed Ordinance No. 4387, which was then submitted for voter approval as “Measure B.”  On January 9, 2018, the Board of Supervisors appointed current members to the Mental Health Treatment Act Oversight Committee.  On September 1, 2020, the Board appointed Supervisors Williams and Haschak as a Measure B Ad Hoc Committee to work with Measure B Staff and the Measure B Committee.

Summary of Request

The Measure B ad hoc committee appointed by the Board of Supervisors has identified a need for clarification of the term length for appointees to the Mental Health Citizen’s Oversight Committee.  Per Ordinance No. 4387, five members of that committee are appointed by the Mendocino County Supervisors.  The Ordinance, however, does not specify the length of these appointments, the method by which an incoming supervisor may make a new appointment, or the process for removing an existing committee member.  Consequently, clarifying rules are needed.

At the request of the ad hoc, County Counsel has prepared a draft ordinance that would specify the terms and removal process for any appointee to a board, commission, or other Mendocino County body.  This draft was written to only apply to those bodies for which no terms have otherwise been established.  Counsel has provided a rough guess as to what the Board might prefer, but additional direction will be necessary regarding term length, process for removal, and whether new supervisors will be empowered to replace prior appointees.
