Previous Board/Board Committee Actions:

On January 25, 2011, the Board approved Board of Supervisors (BOS) Agreement No. 11-008, Caspar Transfer Station Operations and Lease between County of Mendocino and Solid Wastes of Willits, Inc.  From time to time, the Board of Supervisors has authorized amendments to the Agreement to adapt to changing conditions and new information and to make rate adjustments per the terms of the Agreement.  By Resolution No. 16-047 (April 19, 2016), the Board extended the term of the Agreement until June 30, 2021.                     

 

Summary of Request

BOS Agreement No. 11-008, Caspar Transfer Station Operations Agreement and Lease between County of Mendocino and Solid Wastes of Willits, Inc. (Agreement), will expire on June 30, 2021.  As there are no immediate plans to expand or replace the Caspar Transfer Station, it is in the public interest to extend the term of the Agreement to ensure the future operation of the Caspar Transfer Station.  The Agreement provides that the County shall, at its discretion acting with concurrence of City of Fort Bragg, have the option to extend the Agreement on one or more occasions provided that the combined extension periods do not extend beyond December 31, 2029.  The Caspar Transfer Station Joint Coordinating Committee, made up of two Mendocino County Supervisors and two Fort Bragg City Council Members, also recommends the County extend the Agreement to June 30, 2025.  On March 8, 2021, the Fort Bragg City Council passed Resolution No. 4364-2020, which recommends and concurs that the County exercise the option to extend the term of the Agreement until June 30, 2025.  BOS Agreement No. 11-008 requires the County to provide written notice of the extension to Solid Wastes of Willits, Inc., 180 calendar days prior to the expiration of the Agreement.  Written notice was provided as required on December 10, 2020.  Department of Transportation recommends and requests the Board adopt the Resolution extending the term of BOS Agreement No. 11-008 from June 30, 2021 to June 30, 2025.
