PREVIOUS BOARD/BOARD COMMITTEE ACTIONS:
The Board approved Agreement 19-133 and Resolution 19-174 on May 7, 2019. The Board approved Amendment 1 on April 6, 2021.

SUMMARY OF REQUEST:
On May 1, 2019, the Sheriff's Office entered into an agreement with the Department of State Hospitals for the Sheriff's Office Jail to administer the delivery of Jail Based Competency Treatment (JBCT) Program services for inmates. BOS Agreement 19-133 states DSH compensates MCSO at the rate of $29,294.25 per patient inmate. The Agreement is for two years and will not exceed $898,828. The Agreement includes a $20,000 startup fee.

Currently, a hearing occurs, and a psychological evaluation occurs when an attorney declares a doubt, under Penal Code section 1368, as to their clients' mental competence. If a psychologist finds that the client is incompetent, the court case is suspended, and the client is sent to a State hospital to undergo competency training.
