Previous Board/Board Committee Actions:

The Board approved Agreement 19-133 and Resolution 19-174 with the Department of State Hospitals (DSH) to establish the JBCT program on May 7, 2019. The Board approved the First Amendment to Agreement BOS 17-131 with NaphCare Inc. for the JBCT program on July 23, 2019. The Board approved the First Amendment to BOS Agreement 19-133 with the DSH to support more admissions to the JBCT program on April 6, 2021. The Board approved the Second Amendment to BOS 17-131 with NaphCare Inc. to receive the additional DSH funds on May 4, 2021. The Board approved the Second Amendment to BOS Agreement 19-133 on May 25, 2021, to receive additional DSH funds and extend the Agreement until June 30, 2021. A Third Amendment to BOS Agreement 17-131 will be presented to the Board on June 8, 2021, to add the DSH funds to the NaphCare JBCT program and extend it until June 30, 2021.                      

 

Summary of Request

The Sheriff’s Office (MCSO) is entering into a three-year Agreement with DSH to expand the JBCT program at the County Jail. From a Small County Model program, MCSO now provides access to portions of its Jail to administer a dedicated 4 to 6 beds JBCT program for the provision of restoration of competency treatment services for male and female individuals found by the courts to be IST under Penal Code section 1370. MCSO shall be paid in full for the minimum four beds (Allocated Beds) at the per diem rate of $420 per bed, totaling $1,680 per day.  MCSO shall be paid for the additional fifth and sixth beds (Non-Allocated Beds) at the per diem rate of $420 per bed for each inmate's actual number of days in the JBCT program. The DSH agreement shall be from July 1, 2021, through June 30, 2024, and is in the maximum amount of $2,761,920 or $919,800 per fiscal year.

 

After negotiating with NaphCare Inc., they are agreeable to provide all of the services outlined in the DSH contract and be reimbursed by the County in full for the minimum of the four Allocated Beds in the amount of $380.14 per bed, totaling $1,520.56 per day. The daily per diem rate for the Non-Allocated Beds shall be $380.14 per bed for each inmate’s actual number of days in the JBCT program. The Amendment term is from July 1, 2021, through December 31, 2022, and is in the maximum amount of $1,252,181.16.
