Approve the Joint Exercise of Powers Agreement Amendment Number Eight in an amount not to exceed $113,300 annually, $566,500 total, for Mendocino County to join with Napa County, Solano County, Yolo County, and Marin County for continued operation of a joint public health laboratory, to be known as the Napa-Solano-Yolo-Marin-Mendocino County Regional Public Health Laboratory, effective July 1, 2021 through June 30, 2026; authorize the Health and Human Services Agency Assistant Director/Public Health Director or designee to sign any amendments that do not increase the maximum amount; and authorize Chair to sign same.

Summary of Request

California State Code requires each county with a population over 50,000 to provide public health laboratory services either through operation of its own laboratory or through arrangements with an outside agency. Mendocino County currently fulfills requirements for these mandated testing services through a contract with Solano County. The Solano County contract, which was executed as a bridge contract to cover the final six months of Fiscal Year 2020-21 after the expiration of a similar contract with Sonoma County, was put in place in anticipation of joining the Joint Exercise of Powers Agreement (JEPA) with Napa, Solano, Yolo, and Marin Counties. The bridge contract with Solano County expires on June 30, 2021.

 

The Public Health Branch of the Health and Human Services Agency (HHSA) requests Board approval of Amendment No. 8 with the existing JEPA (consisting of Napa, Solano, Yolo, and Marin Counties) for continued operation of a joint public health laboratory, which will be known as the Napa-Solano-Yolo-Marin-Mendocino County Regional Public Health Laboratory after the amendment has been fully executed. The laboratory is located at the existing Solano County Public Health Laboratory site in Fairfield, California. Anticipated costs for Mendocino County include:

                     A fee of $100,000 the first year to support general operational costs. This fee will be increased by an amount equal to the Consumer Price Index in each subsequent year.

                     Up to $7,600 each fiscal year for the purposes of maintaining or replacing laboratory equipment. This fee is based on a combined total of $100,000 for all JEPA members and is calculated at a percentage (7.6%) in proportion to the most recent Mendocino County population numbers. The fee will not be collected until all other avenues of funding, including grants and loans of equipment, have been sought.

                     Up to $5,700 each fiscal year to cover annual maintenance costs of newly acquired instruments for COVID-19 and general lab testing. This fee is also calculated at 7.6% of $75,000 as described above.
