Previous Board/Board Committee Actions:

Adoption of BOS Resolutions 08-053, 11-024, and 18-013, ratifying the adoption of the 2007, 2010, and 2016, respectfully, editions of the California Fire Code with amendments by Ukiah Valley Fire District.  This item was continued from its original August 18, 2020, meeting date along with other Fire Code adoptions, and direction was given to staff at the Board’s November 3, 2020, meeting to return to the Board with additional documents.                     

 

Summary of Request

The Ukiah Valley Fire District has complied with Health and Safety Code section 13869.7(c) by adoption of the attached Ordinance Adopting the 2019 Edition of the California Fire Code with Amendments, Regulating and Governing the Safeguarding of Life and Property from Fire and Explosion and for Providing for the Issuance of Permits, Repealing All Other Ordinances and Parts of Ordinances of the Ukiah Valley Fire District in Conflict Herewith.  No Ordinance adopted by the District shall be effective until ratification by the County where the Ordinance will apply.  Upon ratification of an adopted ordinance, the County shall file a copy of the findings of the District, and any findings of the County, together with the adopted ordinance expressly marked and identified to which each finding refers, with the Department of Housing and Community Development.

 

At its meeting on November 3, 2020, supervisors asked for clarification regarding comments by the Mendocino County Farm Bureau, appendices referred to in the District’s ordinance, and whether a redline markup of the ordinance was available.  While the Farm Bureau made comments on codes adopted by other fire districts in the County, staff is not aware of any comments made on the District’s ordinance.  Appendix B referred to in the District’s ordinance is viewable at the below website, which can also be used to view the California Fire Code and its other appendices as well:

Lastly, no redline was created by the District as part of the preparation of its ordinance.  Many sections of the ordinance are adding to the Fire Code, not amending its existing sections.  Staff would refer interested parties to compare the ordinance to the Fire Code viewable at the above link, and will ask fire districts to create and submit redlines of ordinances as part of future code adoptions.
