Recommended Action/Motion:

Provide direction to staff as to how to proceed.  At this point, the Board can:

1.                     Adopt the Ordinance Adding Chapter 2.39 of the County Code Creating a Public Safety Advisory Board;

2.                     Amend the proposed ordinance to instead create a Sheriff Oversight Board or other alternative model; or

3.                     Provide alternate direction to staff.

Previous Board/Board Committee Actions:

On June 23, 2020, the Board of Supervisors created an ad hoc committee to explore the creation of a potential public safety advisory board. On September 1, 2020, upon the recommendation of the ad hoc, the Board of Supervisors directed County Counsel to prepare the necessary legal framework to establish a public safety advisory board. On January 26, 2021, the Board considered and introduced the requested ordinance.  On February 9, 2021, the Board decided not to forebear enactment of the proposed ordinance and instead directed County Counsel to provide a legal analysis on how this model would differ from a Sheriff Oversight Board as contemplated by AB 1185.                     

 

Summary of Request

In September of 2020, the Mendocino County Board of Supervisors directed County Counsel to draft the necessary legal framework to create a public safety advisory board.  Later that month, Governor Newsom signed AB 1185 into law, which authorized local jurisdictions to create a sheriff oversight board or appoint an inspector general.  In February of 2021, the Board of Supervisors chose to wait before enacting an ordinance creating a public safety advisory board and asked County Counsel to provide a legal analysis on the difference between the two structures.

 

As summarized in the accompanying materials, the Board of Supervisors has several options as to how to structure any advisory or oversight body.  Staff is now seeking direction as to how the Board would like to proceed.
