Summary of Request:
On September 12, 2021, the Hopkins Fire started and has resulted in structural damage and evacuations of several portions of the County.
On September 16, 2021, the Mendocino County Health Officer issued a declaration of local health emergency as of September 12, 2021.
On September 16, 2021, the Chief Executive Officer/Director of Emergency Services proclaimed the existence of a local emergency related to the Hopkins Fire.
California Health and Safety Code section 101080 provides authority for the Health Officer to issue a declaration of local health emergency. Pursuant to Government Code section 8630, whenever an official designated by ordinance proclaims a local emergency, the local emergency shall not remain in effect for a period in excess of seven days unless the governing body has ratified it. Mendocino County Code section 7.04.050 provides authority for the Director of Emergency Services to issue a proclamation of local emergency if the Board of Supervisors is not in session. It is proposed that at its meeting on September 21, 2020, the Board of Supervisors adopt a Resolution ratifying the original proclamation that a state of emergency exists.
The Board of Supervisors must first make a determination, by majority vote, that an emergency exists, and then may take action on the proposed resolution of a local emergency.
