Adopt Resolution authorizing the Department of Social Services (DSS) to enter into retroactive Agreement No. 21-5026 with the California Department of Social Services in the amount of $0 to provide DSS Family & Children’s Services with legal consultation and legal representation in administrative action appeals associated with the Resource Family Approval program for the term July 1, 2021 through June 30, 2024; and authorize the DSS Director to sign any future amendments that do not increase the maximum amount; and authorize Chair to sign same.

Summary of Request:
Since 2017, the California Department of Social Services (CDSS) has provided counties with legal consultation and legal representation in administrative action appeals associated with the state mandated Resource Family Approval program. These services are provided at no cost to the counties when a county has deemed it necessary to deny approval or rescind approval of a Resource Family from being a foster care provider. Although the CDSS Standard Agreement used statewide covers multiple components of the Resource Family Approval program in which counties may contract with CDSS, the only component in which Mendocino County contracts with CDSS is for the legal consultation and representation. The other components listed in the Agreement- Family Evaluations, Complaint Investigations and Health and Safety Assessments- are handled in-house by County staff in the Family & Children’s Services Resource Family Approval Unit.
The Agreement for Fiscal Years 2021 to 2024 was e-mailed to the County from CDSS on July 23, 2021. In addition, due to the separation of the County Department of Social Services from the Health and Human Services Agency in July 2021, this necessitated changes to the name of the County Department specified in the Agreement resulting in further delays of processing this Agreement. The delay in receipt of this Agreement from CDSS was beyond the County’s control and therefore retroactive approval is requested.
