Previous Board/Board Committee Actions:

On February 3, 2015, the Board of Supervisor appointed Chief Executive Officer, Carmel J. Angelo as the Mendocino County Water Agency Director.  Water Agency responsibility has since transferred from the Department of Planning and Building Services to the Executive Office.  On March 3, 2015, the Board adopted a contract with LACO Associates for $94,000 for support services to the Mendocino County Water Agency for the Term of January 1, 2015 to December 31, 2015.  On December 15, 2015, the contract was extended to June 30, 2016.

 

Summary of Request

Mendocino County holds a National Pollutant Discharge Elimination System (NPDES) Phase II permit as an operator of a small municipal separate storm sewer system (MS4). This permit requires many tasks to be completed by the County to remain in compliance. The permit is currently in year three of the five-year permit cycle. In addition to these stringent requirements, new Sustainable Groundwater legislation, passed by Governor Brown in the summer of 2014, has set a timetable for implementing required groundwater monitoring, permitting, and creation of a groundwater agency for all priority basins.  Over the next several years the Ukiah Basin must form a Groundwater Sustainability Agency and develop a Groundwater Sustainability Plan.  These complex programs require increased time and knowledge to ensure compliance with all programs.   With the transfer of the Mendocino County Water Agency responsibilities from the Department of Planning and Building Services to the Executive Office, Water Agency obligations and contract monitoring will be performed by Water Agency Director, Carmel J. Angelo. 

 

Due to the technical nature of these programs, the Water Agency is recommending the use of a consultant for continued assistance. LACO Associates specialize in water related regulations and compliance and have experience working with county departments including: the Water Agency, Executive Office, Planning and Building Services, and the Department of Transportation, to assist in completing water related state mandates.    Due to the extended nature of the above projects, moving forward with a three year contract will provide consistency and produce a final product pursuant to State mandates.  The Contract will be paid from two budget units, depending on the department responsible for specific areas of the contract.  The Water Agency will be responsible for groundwater projects and Planning and Building will be responsible for the NPDES portion.  The majority of the contract will be funded through grant funds received from the California Department of Water Resources ($200,000) and the one-time funding of $150,000 set aside by the Board of Supervisors in FY 2015-16 for assistance in establishing the mandated Ground Sustainability Agency and Plan.
