Previous Board/Board Committee Actions:

March 15, April 18 and May 16, 2016, the Marijuana Ad Hoc brought forward recommendations regarding the development of a permanent medical marijuana cultivation ordinance; May 17, 2016, Board adopted a medical marijuana cultivation urgency ordinance and directed staff to bring back an item to disband the Marijuana Ad Hoc and refer the development of a permanent ordinance to the General Government Standing Committee; June 7, 2016, Board disbanded the Marijuana Ad Hoc and referred the development of a permanent marijuana cultivation ordinance to the General Government Standing Committee; June 20, 2016, July 8, 2016 and July 13, 2016 the General Government Standing Committee provided direction to staff regarding changes to the draft medical cannabis cultivation ordinance and zoning regulation and recommendation for full Board review prior to commencing the CEQA project description and initial study process.  July 12, 2016, Board received an update on the cultivation ordinance development and directed staff to return with a modified draft ordinance incorporating the recommendations of the Board. 

 

Summary of Request

Staff from the Department of Agriculture, Planning and Building, County Counsel and Executive Office have reviewed the recommendations from the Board of Supervisors May 16, 2016, May 12, 2016 and July 12, 2016, meetings and General Government Standing Committee meetings on June 20, 2016, July 8, 2016 and July 13, 2016 and modified the draft Medical Cannabis Cultivation Compliance Program and a Medical Cannabis Cultivation Site Zoning Regulation for your consideration.

 

Staff will be preparing the supporting documentation that will include the input and direction received from the Board of Supervisors on July 8, 2016 and the General Government Standing Committee on July 13, 2016.  Further, staff will present an overview of the cultivation ordinance, site zoning regulation, attachments and recommendations from the Board and Standing Committee.  The Standing Committee requests the Board’s consideration and feedback on the cultivation ordinance and zoning regulation.  Following feedback, the Standing Committee recommends the Board direct staff to commence the CEAQ project description and initial study process.
