Summary of Request:
The voter sponsored initiative titled “An Initiative to Add a Temporary Half-Cent Sales Tax to Fund Facilities in Mendocino County to Assist in the Diagnosis and Treatment of Mental Health and Drug Dependency” (the “Initiative”) was filed with the County Clerk’s Office on June 24, 2016. On July 12, 2016, the Registrar of Voters certified that the petition had sufficient verified signatures.
Following the certification by the Registrar of Voters, County staff became aware that the Initiative, as drafted and signed, did not contain enacting language required by the State Board of Equalization in order for it to collect and administer the tax proposed by the Initiative.
In order to effectuate the will of the voters, should the Initiative be approved by the required two-thirds vote, enacting language must be placed on the November ballot. The Sheriff is proposing, for the Board’s consideration, an urgency ordinance that would accompany the Initiative on the November ballot. The ordinance contains the language required by the State Board of Equalization. However, both the Initiative and the proposed ordinance would need to be approved by a two-thirds vote of the electorate in order to be approved.
Also prepared for the Board’s consideration is a resolution that calls for the election regarding the ordinance, which includes the ballot language.
