A MOU (BOS 09-102) was approved by the Board of Supervisors on June 23, 2009. A Joint Occupancy and Transfer Agreement (BOS 08-093) was approved by the Board of Supervisors on June 24, 2008.  On June 10, 2013, a MOU (BOS 13-028) was approved by the Board of Supervisors.

Summary of Request

Pursuant to the Trial Court Facilities Act of 2002, the County and the Administrative Office of the Courts (AOC) entered into a Joint Occupancy Agreement (JOA) and Transfer Agreement for the court facility location at 700 South Franklin Street, Fort Bragg, commonly known as the Fort Bragg Justice Center.  In lieu of the AOC providing the operations for the Court Exclusive Use Area, the County has provided those services on the AOC’s behalf pursuant to the MOU dated July 1, 2013.  Due to untimely notification on behalf of the AOC to renew the MOU, the 2013 MOU expired on June 30, 2015.  The AOC notified the County that they desire to have the County continue to provide services pursuant to the 2013 MOU.  The County is willing to continue to provide said services for the Court Exclusive Area upon the terms and conditions described in the proposed 2015 MOU.

The County invoices the AOC for services, such as janitorial and building maintenance, and is reimbursed on a quarterly basis.  Anticipated annual revenue from the AOC for the Fort Bragg Justice Center is $16,000 on annual basis for the two-year term of the MOU.

Alternative Action/Motion:

Do not approve the 2015 MOU and recommend amendments and/or direct staff to pursue an alternative course of action.
