Summary of Request

SB 897 would provide an additional year of leave with full salary (also known as “4850 time”) to certain peace officers who have been temporarily or permanently disabled as a result of catastrophic injury on the job. This bill which would create additional burdens for local agencies without a corresponding benefit since existing law already provides a balance of treatment and rehabilitation benefits to workers while maintaining appropriate fiscal commitment from public agencies.

 

Additionally, local agencies already have authority to extend benefits in such circumstances on a case-by-case basis. SB 897 would open local agencies up to increased litigation to costs as the bill is unclear as to what types of injuries would qualify for the additional year of 4850 time.  CSAC requested action by Counties on this bill, and required the County’s immediate action, due to the short time-period from committee to a floor vote by the State Assembly.  This letter is consistent with the principle of local control defined in the 2016 Legislative Platform.  The Executive Office requests ratification of the letter of opposition for SB 897.
