Previous Board/Board Committee Actions:
On December 14, 2015, the Board approved agreement BOS 16-001 with Interactive Resources in an amount of $178,380 for design and engineering services for the Capital Improvement roof replacement projects for the Administration Center and the Public Health buildings On August 4, 2015, the Board approved Resolution 15-113 authorizing the Capital Improvement Projects from the FY 2015-2016 recommended budget. On September 9, 2015, the FY 2015-2016 final budget was approved including roof replacement projects for the Administration Center and the Public Health buildings.
Summary of Request:
Additional engineering and design work to the Administration Center and the Public Health buildings require an additive change order to the original agreement with Interactive Resources. The first phase of the Administration Center regarding design and construction is nearing completion. Design and engineering work continue to move forward for second phase of the project, which includes the south wing of the complex. The additional work for the Administration Center encompasses the records storage building, energy calculations and mechanical changes to modify HVAC unit number eight. The additional charges for this portion of the project equal $7,400.
The Public Health building design and engineering is currently underway and is scheduled for completion this Fall. The scope of change to the original agreement includes added mechanical, architectural, electrical and cost estimating changes required to complete the replacement of obsolete HVAC equipment. The additional charges for the aforementioned scope equal $16,000.
The design and engineering elements added to the original scope of work are necessary to complete both as built drawings and design/drawings currently underway that are necessary for bidding purposes. The total amount of Change Order No. 1 is $23,400, which increases the overall contract from $178, 380 to $201,780.
The net result of the Change Order exceeds the statutory change order limit by $5,570. Changes exceeding the statutory limit would ordinarily require competitive bidding. However, under Gray v. Pasadena Redevelopment Agency (1980) 104 Cal.App.3d 631, competitive bidding is not required where such bidding would be unavailing and impractical, and would not produce any public advantage. Competitive bidding for the extra work in the case would not produce any public advantage, and it is in the County’s and Public’s best interest to work with the existing contractor on the project rather than competitively bid these project changes.

Do not approve the change order and provide staff further direction.
