recommendation
Adopt Ordinance amending section 3.16 of Title 3 of the Mendocino County Code to modify section 3.16.140, titled “Appeals;” and authorize Chair to sign same.
End
Previous Board/Board Committee Actions:
Ordinance No. 437 was adopted in 1962, with multiple amendments since, the last being Ordinance No. 4340, passed July 7, 2015. The Board of Supervisors introduced and waived reading of the ordinance amendment on December 20, 2016.
Summary of Request:
The ordinance currently requires appeal hearings to be conducted within twenty (20) days of date the appeal is filed with the Civil Service Commission. In most cases, the appellant and the County are not able to prepare their respective cases and participate in required pre-hearing conferences within twenty (20) days. Modifying the requirement to conduct a hearing within thirty (30) business days provides a more practical opportunity for the parties to communicate and prepare their cases.
Alternative Action/Motion:
Direct staff to study alternatives.
