Previous Board/Board Committee Actions:
On January 24, 2017, the Board of Supervisors adopted a Resolution introducing, reading the title of and waived further reading of the Ordinance, and called for the public hearing to be scheduled for this date.
Summary of Request:
The State of California adopts new building construction codes every three years, referred to as the California Building Standards Code. The new 2016 California Building Standards Code became effective January 1, 2017, and is enforced locally as mandated by the State. Staff has prepared a proposed Ordinance adopting the 2016 code into Chapter 18.04 of the Mendocino County Code, and is making amendments to the State Codes, based on local Mendocino County conditions, in order to amend sections of Chapter 18.04 and 18.08 with the goal of making these existing requirements easier for staff and the public to reference. The proposed Ordinance will also make other technical changes to Title 18. Government Code procedures call for a first reading of the ordinance and a noticed public hearing prior to the second reading and adoption of the Ordinance. Minor alterations to the ordinance are proposed by staff pursuant to the memorandum attached as part of this agenda packet.
Alternative Action/Motion:
Provide further direction to staff; adopt the State Codes with fewer, or no, local amendments; or take no action. “No action” would result in the continuation of obsolete references within Title 18, which may be confusing to the public or in conflict with mandated State regulation, and conflict with other current local requirements. However, even under the “no action” alternative, the State mandated codes would still be applied by the Department of Planning and Building Services.
