Previous Board/Board Committee Actions:
On June 7, 2017, the Board gave direction to write a letter opposition for AB 1250 and on June 20, 2017 ratified a letter of opposition for AB 1250.
Summary of Request:
It is requested that the Board of Supervisors ratify the submission of a letter opposing Assembly Bill 1250 regarding contracts for personal services. Assembly Bill 1250 restricts the ability of counties to contract with partner agencies to provide services. The letter, dated August 28, 2017, was distributed to Senator Bill Dodd, Senator Mike McGuire, Assemblymember Cecilia Aguiar-Curry, Assemblymember Marc Levine, and Assemblymember Jim Wood. The letter, which was time sensitive, was signed by the Chair of the Board of Supervisors of Contra Costa County, Colusa County, Del Norte County, Humboldt County, Lake County, Mendocino County, Napa County, Sacramento County, Solano County, Sonoma County, Trinity County, and Yolo County.
Assembly Bill 1250 (Jones-Sawyer) would impose a de facto prohibition on counties’ ability to contract with nonprofits, licensed experts and community businesses to deliver vital local services. AB 1250 will jeopardize local services for California’s most vulnerable people and increase costs for taxpayers.
AB 1250 imposes significant new restrictions and layers of bureaucracy designed to stop counties from contracting with nonprofits, licensed professionals and other providers for local services. Restricting counties’ ability to contract for the expertise and the most efficient delivery of services would result in decreased quality and access to services or even the elimination of some services for our most vulnerable.
Both the California State Association of Counties (CSAC) and the Rural County Representatives Counties (RCRC) oppose this bill. CSAC and RCRC are strongly advocating against AB 1250 on behalf of counties to product counties ability to contract for services for our most vulnerable populations. Mendocino County has activity been providing information to CSAC, RCRC and our state representatives regarding the impacts AB 1250 would have the counties ability to contract for services.
An opposition position is consistent with the local control and regulatory reform provisions of the County's 2017 Legislative Platform. Therefore, it is recommended the Board ratify the opposition letter for AB 1250.
Alternative Action/Motion:
Provide direction to staff.
