Summary of Request

As part of a parcel division, in 1972 the County of Mendocino accepted a grant deed from William W. Fish and Jeanne L. Fish, for real property constituting a portion of Oat Gap Road, County Road 241, and more particularly described as follows:  “Parcel ‘A’ as shown upon the parcel map filed for record on June 23, 1972 in Map Case 2, Drawer 17, Page 83, Mendocino County Records”. It has now come to the attention of the Mendocino County Department of Transportation (“DOT”) and Pacific Gas and Electric (“PG&E”) that due to an ambiguity in the land survey performed as part of the parcel division, PG&E may have retained some property interest in the land deeded to the County. PG&E desires to quitclaim any interest in the described property to the County of Mendocino, in the form but must obtain regulatory approval from the California Public Utility Commission (“CPUC”) before it does so the CPUC has requested that in order for it to approve PG&E’s offering of the quitclaim deed to the County, the County must provide some indication that the County is willing to accept the quitclaim deed, if submitted by PG&E. DOT has reviewed the proposed quitclaim deed, which is attached to the agenda packet accompanying this resolution, and supports the acceptance of the quitclaim deed.

 

Alternative Action/Motion:

Postpone approval of a Resolution stating Mendocino County’s intention to accept a Quitclaim Deed from Pacific Gas and Electric.
