Previous Board/Board Committee Actions:
During their January 9, 2018 Board of Supervisors meeting, staff was directed to prepare an agenda item to discuss development of overlay exemption process with the County’s consultant, Michael Baker International.
Summary of Request:
The Board of Supervisors discussed the Cannabis program and related issues, including the development of an overlay that would provide for a means to allow cultivation in areas that are not qualified pursuant to the County’s ordinance. Further, the Board discussed a potential process to consider those property owners who may wish to “opt-out” of the cannabis cultivation ordinance where the ordinance may allow for it. The Board of Supervisors discussed the process and timelines being utilized by the County’s Cannabis Overlay Exemption Development Consultant and the input from Cannabis Regulations Working Groups comprised of County staff members and select stakeholders. Based upon the concerns of the Board of Supervisors regarding the potential timelines and in considering that the Scope of Work with Michael Baker International included the development of a Cannabis Overlay Exemption - and not a Cannabis “opt-out” process development, the Board requested that the representatives from Michael Baker be present to provide the Board with an update and discuss potential timelines and the process regarding the development of the various cannabis related processes.

Do not discuss the cannabis overlay exemption development process and provide direction to staff.
