RECOMMENDED ACTION/MOTION:
recommendation
Approve Amendment to Board of Supervisors Agreement No. 17-098 with Mitchell, Brisso, Delaney & Vrieze increasing the amount from $100,000 to $150,000 for litigation services in Linda Morales v. County of Mendocino, et al.; and authorize Chair to sign same.
End

PREVIOUS BOARD/BOARD COMMITTEE ACTIONS:
The Board of Supervisors approved an amendment to Purchasing Agent Agreement No. 17-173 with Mitchell, Brisso, Delaney & Vrieze on September 12, 2017 for an amount from $50,000 to $100,000 for litigation services in Linda Morales v. County of Mendocino, et al.

SUMMARY OF REQUEST:
The firm of Mitchell, Brisso, Delaney & Vrieze has been retained to handle the lawsuit of Linda Morales v. County of Mendocino, et al. in Federal Court due to a conflict with our office. The costs related to this lawsuit involve an extensive number of depositions including two witnesses residing in two separate states. A summary judgment motion has been filed. It is hoped that we will spend less than $150,000 for the total fees, however, a jury trial is set for April 2018 so costs could continue to escalate.

ALTERNATIVE ACTION/MOTION:
Do not approve.
