PREVIOUS BOARD/BOARD COMMITTEE ACTIONS:
Adoption of Resolution No. 15-054 determining that resumption of asphalt production on the subject property is not a new or changed use pursuant to the Mendocino County Code. Adoption of Resolution No. 15-087, rescinding Resolution No. 15-054.
SUMMARY OF REQUEST:
The Board's adoption of Resolution No. 15-054 was challenged by the Friends of Outlet Creek, which litigation is currently on appeal before the First District Court of Appeal. This lawsuit, as well as several related lawsuits, is the subject of a Settlement Agreement agreed to by the Board in closed session on February 6, 2018, and entered into between the various interested parties. Pursuant to the Settlement Agreement, the County has until April 6, 2018, to rescind both Resolution Nos. 15-054 and 15-087.
