Adopt Resolution authorizing the Coastal Commission to accept and process a Consolidated Coastal Development Permit request for the California Department of Transportation to implement interim mitigation measures to minimize recreational user exposure from lead impacted soil and lead dust within the interior of an existing residence at 2801 Spring Grove Road, Albion (APNs: 123-360-06 and 123-340-01); and authorize Chair to sign same.

Previous Board/Board Committee Actions:

The Board of Supervisors has previously authorized the consolidation of Coastal Development Permits for other projects with shared jurisdiction between the County and the California Coastal Commission where public participation was determined not to be impaired.                     

 

Summary of Request

On March 7, 2018, Planning and Building Services received a request from the California Department of Transportation (Caltrans) for a Consolidated Coastal Development Permit to implement interim mitigation measures to minimize recreational user exposure from lead impacted soil and lead dust within the interior of an existing residence at 2801 Spring Grove Road (APNs 123-360-06 and 123-340-01). The interim mitigation measures will be in place until a Department of Toxic Substance Control approved final cleanup plan for the site is implemented in conjunction with the future Salmon Creek Bridge Replacement Project. The project is located on parcels with split jurisdiction between the County of Mendocino and the California Coastal Commission.

 

The proposed consolidation request would allow for streamlined processing of the project and review of the entire project in one permit. The Coastal Act was amended by Senate Bill 1843 effective January 1, 2007, which allows for a consolidated permitting process for projects when the Coastal Development Permit authority is shared by a local government and the California Coastal Commission. The project focus is on the unpaved access road, parking area and the adjacent exterior areas of the residence to prevent further tracking of lead contaminated soils into the residence, and to minimize recreational user exposure from lead-impacted soil and lead dust within the interior of the residence. The project is under the coastal development permit authority of both Mendocino County and the California Coastal Commission and would otherwise require a coastal development permit from both Mendocino County and from the California Coastal Commission for the portions of the project located within each jurisdiction. Public participation will not be substantially impaired, as the California Coastal Commission will hold a public hearing, which may be attended by interested parties or interested parties may submit comments in advance of a meeting.

Reject the Resolution and direct staff to process a Coastal Development Permit for that portion of the project located in the County’s jurisdiction.
