Recommended Action/Motion:

Adopt Resolution delegating certain functions to the County Executive Officer and County Counsel with respect to the administration of the general liability claims against the County; and authorize Chair to sign same.

Previous Board/Board Committee Actions:

On February 15, 2005, the Board, in adopting Resolution No. 05-020, established settlement authority for the County Administrative Officer or his/her designee for general liability claims against the County if the settlement is approved by County Counsel.

 

Summary of Request

It has been learned that other County Boards, including Sonoma and Napa, have delegated their authority to reject claims to an employee. This method is more efficient in that is saves placing matters on the Board’s agenda, and gives the employee the full 45 days to determine if the claim can be resolved, within their authority limit, and does not need to be rejected.

 

Adopt the resolution delegating authority to the County Executive Officer, with approval by County Counsel, with respect to the administration of the general liability claims against the County.

Do not adopt resolution and return to staff with further direction.
