Previous Board/Board Committee Actions:
On May 17, 2016, the Board of Supervisors approved the Draft Mendocino County LAMP for initial submittal to the North Coast Region Water Quality Control Board (NCRWQCB). The draft LAMP was submitted to the NCRWQCB in June 2016 for review and approval. The NCRWQCB provided comments in January 2017, and approved the revised LAMP in March 2017.
Summary of Request:
In 2000, the California Legislature passed Assembly Bill 885 (Water Code § 13290) which required the State Water Resources Control Board (SWRCB) to adopt regulations or standards for the permitting and operation of Onsite Wastewater Treatment Systems (OWTS). The Mendocino County LAMP is required due to mandates set forth in the State’s Onsite Wastewater Treatment System (OWTS) Policy referred to in AB885. The LAMP proposes alternate criteria for the design, siting, operation, and maintenance of OWTS based on soil types common to Mendocino County. Health and Human Services Agency-Environmental Health staff will provide an informational presentation regarding revisions made to the LAMP that was approved by the Mendocino County Board of Supervisors on May 17, 2016. The revisions are based upon comments received from various program units within the North Coast Region Water Quality Control Board. The LAMP is based upon existing practices and policies which will achieve compliance with the law while protecting public health and the waters of the State. The LAMP has been developed with public and county stakeholders. The State OWTS Policy began implementation in 2013, and required counties proposing alternate policy to submit a LAMP to the Regional Water Board by May 13, 2016. Environmental Health has submitted the Draft Mendocino County LAMP to the North Coast Region Water Quality Control Board as required, and has obtained the Regional Board’s initial approval of the revisions that were made. After the revised LAMP is approved by the Mendocino County Board of Supervisors, Regional Board staff will take it to the State Water Resources Control Board for approval.
Alternative Action/Motion:
Do not approve the revised LAMP; refer the matter to staff for additional research and alternatives.
