Approve Retroactive Agreement with the State Air Resources Board to accept state Carl Moyer Rural Assistance Program Funds in the amount of $59,236.27 for the term of May 15, 2018 through April 30, 2020 for a project in Mendocino County; approve the project associated with the funds; approve expenditure of funds by December 31, 2022; authorize the District to enter into a contractual agreement with the applicant that outlines the requirements associated with the funds; authorize the District to transfer the funds to the applicant upon completion of the project; and authorize Chair to sign same. Direct the Clerk of the Board to provide a Minute Order to the District of the Board's decision.

Previous Board/Board Committee Actions:
On March 27, 2012, the Air Quality Management District Board authorized the District to accept state Carl Moyer Rural Assistance Program Funds for a project in Mendocino County, enter into a contractual agreement with the applicant that outlined the requirements associated with the funds and transfer the funds to the applicant of funds upon completion of the project.
Summary of Request:
The California Air Resources Board (ARB) administers The Carl Moyer Program. The Program creates incentives in the form of grants for private companies or public agencies that operate heavy-duty diesel engines in California. These grants are used to cover an incremental portion of the cost of purchasing new, replacing existing, or retrofitting existing diesel engines or equipment with cleaner -burning engines or equipment. Unspent funds from each District are reallocated to the state Carl Moyer Rural Assistance Program Fund. The State requires Board authorization to accept the funds, approval of the project associated with the funds, authorization for the District to enter into a contractual agreement with the applicant and reimburse the applicant upon completion of the project. The state currently has $52,569.60 in unspent funds available which the District has agreed to apply toward a project to be completed prior to June 30, 2021. The District will also receive $6,666.67 in administrative funds associated with the project.
The District signed the Grant Agreement between the District and ARB on May 24, 2018 to reserve program funds for the District. The District was not able to bring the item to the Board prior to signing the Grant Agreement. Additional delays were due to staffing shortages which required the District’s Program Manager to fulfill the duties of the vacant position. ARB has accepted the District’s signed Agreement pending Board approval in the form of a Minute Order.
