On January 24, 2017, the Board of Supervisors approved BOS Agreement No. 17-003.
Summary of Request:
BOS Agreement No. 17-003 was approved as a two year agreement with the potential to extend, as needed. Since PBS has utilized the services of MSWMA for successful and cost effective cleanup of public nuisances on a case by case basis, staff requests the extension of the MOU. Although this amendment is technically retroactive, MSWMA provided no services to the County under the terms of the original agreement after it expired on June 30, 2018. Pursuant to the priorities of the Board of Supervisors, the PBS Code Enforcement Division continues to seek methods for streamlining public nuisance abatement in a timely and efficient manner as allowed by statute. Each step in the process of nuisance abatement requires resources that ideally must be in place ahead of time in order to eliminate unnecessary delay in accomplishing the desired task within the time frames allowed by ordinance and due process, specifically the administrative or summary abatement of the nuisance condition if that becomes necessary. Individual procurement of cleanup services for each case at the time of need unnecessarily delays that outcome by weeks or months while waiting for pre-authorization to utilize and pay an agency to conduct the cleanup. Often by the time a code compliance case reaches the point of necessary administrative abatement and cleanup, court authorization with time limitations have to be obtained and any unnecessary delay in gaining authorization to utilize an entity to conduct the cleanup will conflict with the strict timelines as authorized by the Court for the PBS to enter the property to conduct the cleanup. The County’s standing agreement with MSWMA allows for expedited abatement response in some situations.
