Previous Board/Board Committee Actions:

The original Joint Occupancy Agreement (JOA) for the Ukiah Courthouse, between the Judicial Council and the County, was approved by the Board of Supervisors on December 23, 2008.

Summary of Request

In 2001, the Judicial Council of California began working with the 58 California Counties to reach agreement about the ownership of more than 500 court facilities.  In counties where the court was the sole occupant of a facility, the counties transferred ownership of these courthouses to the State.  In instances where the courthouse was “mixed use”, meaning the court was not the only occupant of the facility, the Judicial Council and the counties executed Joint Occupancy Agreements (JOA).  JOAs are currently in place for the Ukiah & Fort Bragg courthouses, in addition to the Willits Justice Center.

In addition to defining rights and responsibilities for the parties, JOAs were executed to:

1.                     Memorialize the percentage of space held by the court and other entities

2.                     Describe facility sharing arrangements for common use space

3.                     Determine how routine maintenance and capital improvements would be performed and how costs would be divided.

The proposed amendment includes minor cleanup language, and primarily increases the square footage of space allocated to the County in the Ukiah courthouse from 13,600 sf to 13,887 sf.  The additional space will be allocated to the District Attorney for storage.  The square footage split will change from 32.38%/67.62% (County/State) to 33.06%/66.94% (County/State) and will proportionally increase the County share of mutual expenses.

Alternative Action/Motion:

Do not approve the amendment or provide direction to staff
