SUMMARY OF REQUEST:
The Mental Health Treatment Act Citizen's Oversight Committee ("Committee") meets one time per month for approximately two hours per meeting. Currently County Counsel does not attend the meetings. The Committee previously requested an opinion from County Counsel regarding their ability to approve funds for a design or construction project and that was provided to them. On December 5, 2018, the Clerk of the Committee sent another request for a 'legal opinion regarding Measure B funds being used for remodeling of the Ukiah Adventist Hospital vacant ER/ICU for a Psychiatric Facility'.
Due to that request, on December 19, 2018, County Counsel attended the Committee meeting and stated that it would be necessary to seek Board of Supervisors approval for County Counsel to regularly attend the Committee meetings and to render legal opinions to the Committee since the Committee is an advisory committee and the Board has to approve the expenditure of funds. It was requested by the Committee that County Counsel seek that approval from the Board of Supervisors.
ALTERNATIVE ACTION/MOTION:
Return to staff for alternate direction or authorize Committee to hire outside counsel.
