Previous Board/Board Committee Actions:
August 12, 1974 - CSA 3 was formed. On February 5, 2019, the Board of Supervisors directed staff to research the feasibility of reactivating CSA 3 and to potentially provide letter signed by the Chair to the State Controller and/or LAFCO asking for a delay while the Board determines options.
Summary of Request:
SB 448 passed in 2017, which includes provisions regarding Special Districts that are inactive. The legislation requires the State Controller’s Office to create a list of inactive special districts based on information in the special district’s Financial Transaction Report, to publish a list of inactive districts, and to notify LAFCOs of inactive special districts within its county.
On November 6, 2018, Mendocino LAFCO received notice from the State Controller’s Office that Mendocino County CSA 3 was identified as inactive.
Pursuant to the State Controller’s Office direction and the provisions of SB 448, LAFCO must determine the status of the CSA 3 and consider adopting a resolution initiating the dissolution of the CSA within 90 days of receipt of the notice (or by February 6, 2019). Subsequent to adopting the resolution, LAFCO must conduct a public hearing to formally dissolve the district within 90 day and transmit said notification to the State Controller’s Office.
LAFCO transmitted notice to the County Executive Office, Auditor-Controller, and County Counsel. Having heard no objection to the proposed dissolution of CSA 3, the Board of Supervisors is being presented with this for discussion purposes and to provide any comments to LAFCO prior to proceeding with the dissolution process.
Please refer to the attached documentation from LAFCO and the State Controller’s Office for additional information.
