RECOMMENDED ACTION/MOTION:

Adopt Resolution designating the Department of Planning and Building Services as the department to administer Chapter 10A.17 of the Mendocino County Code, the Mendocino Cannabis Cultivation Ordinance; and authorize chair to sign same.

PREVIOUS BOARD/BOARD COMMITTEE ACTIONS:
On April 4, 2017, by Ordinance No. 4831, the Board of Supervisors added Chapter 10A.17 to the Mendocino County Code regarding cannabis cultivation permits. On April 28, 2018, by Ordinance No. 4408, the Board of Supervisors amended section 10A.17.020 and the definition of "Agricultural Commissioner" to allow for the Board to designate other departments or divisions of the County to administer Chapter 10A.17.

SUMMARY OF REQUEST:
In March 2018, Mendocino County created the Cannabis Program Unit within the Department of Agriculture to implement the county's Cannabis Cultivation Program, coordinate with departments, streamline processes to effectively implement the Cannabis Program, develop a sustainable framework to institutionalize the program into County government and establish a County infrastructure that evolves with changes in the developing cannabis market.
