Summary of Request:
On February 10, 2017, County Counsel Katharine Elliott submitted a request to the Attorney General for a formal opinion regarding the County’s ability to enforce a local ordinance as applied to commercial timber operations. The request sought clarification as to whether the County ordinance adopted as Measure V is partially preempted by state law. That opinion, which has been designated as Opinion Number 17-202, has not yet been issued.
During Supervisors’ reports on April 9, 2019, it was reported that one or more Supervisors had individually inquired of the Attorney General as to the status of the opinion. This item is now brought forward in order to allow the full Board to request that the opinion be expedited.
