Summary of Request:
California Health & Safety Code (HSC) § 1797.270 states “[a]n emergency medical care committee may be established in each county in this state.” Although not an official committee of the Board of Supervisors, a large group of local stakeholders known as the Emergency Medical Care Committee (EMCC) has been meeting regularly for at least the past 20 years. Although by-laws were drafted by this stakeholder group in the late 1990’s and early 2000’s, the group never formalized or brought these by-laws and structure to the Board of Supervisors.
In the fall of 2018, participating stakeholders asked to review and update said by-laws and asked the County to consider formal formation of an EMCC with prescribed roles under California Health and Safety Code. With Public Health staff support, the Health and Human Services Agency (HHSA), along with Coastal Valleys Emergency Medical Services Agency staff (CVEMSA), met with EMCC stakeholders on 9/7/18 and 9/21/18 to review prior draft by-laws, consider current requirements, and discuss various membership provisions. HHSA submitted an initial draft of proposed by-laws for approval by the Board of Supervisors on 10/16/2018. The Board recommended that item be continued to allow further refinement of membership requirements. Requested changes included removal of the five EMCC members to be designated by Supervisors and expansion of representation from law enforcement. On 2/26/19, HHSA returned to the Board for approval of revised by-laws. At that time, it was agreed that additional changes were needed, including representation from the Mendocino County Association of Fire Districts, potential for public representation, and greater balance between coastal and inland representation.
If established, HSC § 1797.276 states that every EMCC “shall, at least annually, report to the authority, and the local EMS agency observations and recommendations relative to its review of the ambulance services, emergency medical care, and first aid practices, …” It goes on to state that “[t]he emergency medical care committee shall submit its observations and recommendations to the county board or boards of supervisors which it serves and shall act in an advisory capacity to the board or boards of supervisors which it serves, and to the local EMS agency, on all matters relating to emergency medical services as directed by the board or boards of supervisors.”
Upon Board approval of the proposed by-laws, EMCC will submit a number of membership applications to the Clerk of the Board for appointment by the Board of Supervisors.
