On 12/17/13, Resolution 13-127 was approved which endorsed membership in NBNCBC; 9/9/14 Agreement No. 14-069 was the original NBNCBC MOU. 12/18/15 the MOU was extended through June 30, 2019.
Summary of Request:
Mendocino County is a participant in the four county North Bay North Coast Broadband Consortium (NBNCBC). The NBNCBC was established in 2014 to coordinate efforts to improve broadband access in the North Coast region. In 2014, the CPUC awarded NBNCBC a two-year grant for $250,000 to help plan for telecommunications, broadband deployment, and services to unserved and underserved areas in Marin, Mendocino, Napa and Sonoma counties. A second grant for $250,000, over two years, was awarded in 2017, to continue planning and implementation of broadband projects. Both grants included funds for each county to support their work plan activities.
Currently, Mendocino County is represented on the Oversight Committee of NBNCBC by Supervisor Ted Williams and alternate Supervisor John Haschak. The current NBNCBC Mendocino Management Team is the Economic Development and Financing Corporation, which is contracted as the County’s Broadband Coordinator and has, along with providing other broadband services, the responsibility under that contract to: “Serve as the NBNCBC County Manager including fulfilling the requirements for Mendocino County’s Work Plan as required in the NBNCBC grant award by the CPUC; Work in collaboration with the NBNCBC on calls, reports, presentations, meetings, data analysis, letters, legislation, white papers and other consortium activities”. The MOU between the counties that establishes the consortium expired on June 30, 2019. This item is retroactive because of revisions and improvements made late in the renewal process by the MOU’s lead jurisdiction.
The Board of Supervisors is asked to approve an Amended Memorandum of Understanding that is effective retroactive to July 1, 2019 and terminates on December 31, 2023. This Amended MOU is essentially the same as the current approved MOU. Changes made include: references to the new dates of the MOU period; dates and terms of the newly submitted (May 11, 2019) application for a $450,000 three-year grant from the California Public Utilities Commission’s (CPUC) California Advanced Services Fund (CASF) - Rural and Urban Regional Broadband Consortia Grant Account; update of the current CPUC goal for broadband service in California; updates of the roles of the NBNCBC Oversight Committee (comprised of Supervisors from each county); and update of Sonoma County’s fiscal administrator contact. This Amended MOU will continue the work of the previous 5 years.
The Action Plan of the consortium, for the next three years, as stated in this Amended MOU, is to “work to facilitate the development and implementation of three project areas: 1) advocacy with various community, county, state and federal agencies on broadband goals and policies; 2) activities associated with future CASF grant NBNCBC Project Plan; and, 3) middle-mile broadband infrastructure access that will benefit each county and the region”.
The 2019 - 2022 CASF application designates all of Mendocino County’s portion of the grant towards reimbursement of a portion of the services for the contracted County Broadband Coordinator/Team Manager. In the upcoming grant, if the award is the full amount requested in the application, Mendocino County will receive a total of $97,500 over three years or $32,500 annually.

budget clarification: This item is an MOU without associated funding. However, the consortium has been successful in receiving grant funds to reduce the costs of broadband planning activities. The consortium created by the MOU has recently submitted a grant application, with potential funding to Mendocino County in the amount of $97,500 over three years, or $32,500 annually. Through a $40,000 annual contract, EDFC is serving as the County’s broadband coordinator.
