RECOMMENDED ACTION/MOTION:

Approve temporary construction Right of Entry Agreement, authorizing Ukiah Natural Foods Cooperative to temporarily utilize an unpaved vacant lot owned by the County as a construction staging area during the course of a remodeling project, effective when Agreement becomes fully executed through project conclusion (approximately two years); and authorize Chair to sign same.

SUMMARY OF REQUEST:
The Coop will be expanding its store located at 721 S. State St in Ukiah. The County owns adjacent land, including a vacant, unpaved lot behind the Yokayo Center at 727, 737, and 747 S. State St. The County has no plans for the vacant lot during the anticipated construction period, and currently prohibits parking on the lot to avoid generating dust. The County could assist the Coop in completing its expansion by allowing the Coop to use the vacant lot as a construction staging area. The County will incur no costs through this agreement, and the Coop will be required to minimize disruption or inconvenience to County staff in the area. Additionally, in lieu of other compensation the Coop will install compacted road base over portions of the lot to assist with dust control.
