Approve amendment to Board of Supervisors Agreement No. 17-161 with Nacht & Lewis Architects in the amount of $47,730, for a new total revised Agreement amount of $2,957,730, for a detailed analysis of energy use options for the Mendocino County SB 844 New Jail Facility and extending of the Agreement term through June 20, 2023; and authorize Chair to sign same.

Approval of Agreement 17-161 on December 19, 2017; Approval of agreement BOS 19-239 with Vanir Construction Management for the SB 844 New Jail Facility on October 1, 2019 with discussion providing direction to staff to explore energy efficiency measures in the design of the SB 944 New Jail Facility.
Summary of Request:
At the October 1, 2019 Board meeting approving an Agreement for Construction Management Services with Vanir Construction Management for the SB 844 New Jail Facility, discussion included inquiries about the energy efficiency of the New Jail Building envelope, heating and cooling systems. In response staff requested a proposal from Nacht & Lewis, architects for the project to perform energy cost analysis studies with various heating and cooling system and insulation options to include annual energy cost and construction cost differences. This proposal has been incorporated into this agreement amendment for approval. Upon completion of the study, the Architect will present the County with options for altering the Project design for this Boards consideration. The original contract term was from December 19, 2017 through June 30, 2021 with options to extend the contract up to three (3) additional years. The current planned schedule, shows County occupancy on June 22, 2023. The Architect will be responsible to provide services under this contract through occupancy. This time extension will allow their work to continue without interruption through the full project schedule.
Alternative Action/Motion:
Reject this amendment and direct the staff to move forward with the current building design with no further study.

budget clarification: The new jail facility is currently budgeted at approximately $27,500,000, including $2,500,000 of County General Fund match for all costs in excess of the State SB 844 award of $25,000,000. The County General Fund match can be used for this unbudgeted $47,730 energy use study. However, this increases the likelihood of a funding shortfall for the project at some point in the future, requiring additional General Fund. Any increased construction costs necessary to implement options explored in the study will certainly require additional General Fund.
