Previous Board/Board Committee Actions:
Approval of the District’s Carl Moyer Program Application Annually for Fiscal Years 1999 through 2021. Grant Program Guidelines, including the Carl Moyer Program, were most recently amended by the Board on 5/15/07. On 12/14/21, the Board approved a prioritized list of applications for CMP funds for Program Year 23.
Summary of Request:
The Carl Moyer Program is administered by the State Air Resources Board (ARB). Funding originates from the “smog-check waiver fee” and the tire impact fee assessed by the State. The Program creates incentives in the form of grants to cover an incremental portion of the cost of purchasing new, replacing existing, or retrofitting existing diesel engines with cleaner on-road and off-road engines. Diesel engines contribute about 40% of all oxides of nitrogen emissions (NOx) from mobile sources. NOx is one of the main contributors to ground-level ozone. A secondary focus of the program is reducing the PM-10 and toxic compounds also contained in diesel exhaust.
Since 2000, the MCAQMD has provided funding through the CMP Program in an amount exceeding $4.4 million to public agencies and private companies for projects in Mendocino County.
For Fiscal Year 2021-22 (CMP Year 24), MCAQMD’s allocation is $200,000. ($175,000 for projects, $25,000 for admin.). On October 26, 2021, due to staffing shortages, MCAQMD staff submitted the application to the state ARB as required to secure Year 24 funds and requesting the Year 24 allocation be designated to the Rural Assistance Program (RAP) administered by the California Air Pollution Control Officers Association (CAPCOA). In February 2022, MCAQMD staff requested that ARB reconsider the redirection of funds to RAP. However, due to program requirements and time frame, the funds had been redirected with no options to regain the direct allocation for this Program Year.
Although MCAQMD has designated the Year 24 funds to the RAP, the RAP program has indicated that at least 2 projects in Mendocino County will be funded (approximately $185,000). Project funding and administrative funds will be sent to MCAQMD, and MCAQMD will manage the projects.
The projects funded by the RAP Program will be brought before the Board for approval at a future date. ARB has accepted MCAQMD’s signed Application pending Board Resolution.
The Air Resources Board requires a Resolution, and MCAQMD staff recommend a Resolution from the Board ratifying MCAQMD’s Grant Application for the State Carl Moyer Program for Fiscal Year 2021-22 (Funding Year 24); authorizing MCAQMD to accept grant funds in the amount of $200,000; authorizing MCAQMD to allocate the funds to the RAP; and authorizing the Air Pollution Control Officer to execute the grant agreement on behalf of the MCAQMD.
Alternative Action/Motion:
Do not ratify MCAQMD’s application for the Carl Moyer Program for Fiscal Year 2021-2022, which will keep the allocated funds with the Rural District Assistance Program but will not allow projects in Mendocino County to receive any of the funding.
