recommendation
Authorize the Agriculture Commissioner to establish a Restricted Area Access Agriculture Pass Program and a Livestock Pass Program pursuant to California Food and Agriculture Code section 2350 (“Ag Pass Program”).

Previous Board/Board Committee Actions:
On May 3, 2022, this Board discussed the Ag Pass Program and gave direction to staff to include commercial kennels as an additional type of business that could apply under the program.
Summary of Request:
The Mendocino County Department of Agriculture, Mendocino County Office of Emergency Services, the Mendocino County Sheriff’s Office, and Mendocino County Animal Care Services have worked in partnership to establish a restricted area access program. California Food and Agriculture Code section 2350 specifically allows for a Board of Supervisors to Authorize the Agriculture Commissioner to create a Livestock Pass Program. The proposed Mendocino County Ag Pass Program would include a Livestock Pass Program that meets the requirements of section 2350.
The Ag Pass Program would permit qualifying agricultural producers and/or commercial livestock operators, permitted cannabis operators and commercial kennel operators to gain entrance to evacuation zones, or other restricted areas, to provide feed, water, medical treatment or other care to commercial livestock and/or to tend to commercial agricultural commodities or products. Access under this program would be permitted only to the extent that emergency personnel determine that such access is appropriate under the circumstances at the time that access is requested.
CalFire and California Highway Patrol have been consulted on this program.
Similar programs are being implemented in neighboring counties.
Supervisors Haschak and McGourty support authorizing the Agriculture Commissioner to adopt this Ag Pass Program.
