Previous Board/Board Committee Actions:

December 8, 1992, the Board amended Policy #3 stating that fees will not be waived for Building or Planning fees.

 

March 7, 2017, the Board adopted Ordinance No. 4380 including section 18.08.030 of County Code, which specifies penalties for violations of doing work without first obtaining a building permit.

 

December 14, 2021, the Board adopted Resolution No. 21-194 amending the Master Fee Schedule including Building Permit fees, which schedule includes Violation/Penalty fees as specified in section 18.08.030 of County Code.

 

September 12, 2023, the Board provided direction to Planning and Building Services to establish an amnesty program that would waive Violation/Penalty fees pursuant to Mendocino County Code section 18.08.030 related to building permits submitted after the work has already commenced or been completed, which are not associated with a confirmed code enforcement case. The Board further directed that the amnesty program would be limited to one year.                     

 

Summary of Request

As directed by the Board on September 12, 2023, Planning and Building Services requests adoption of a resolution waiving building permit violation/penalty fees for eligible amnesty building permits for the period of November 1, 2023 to November 1, 2024.

 

The amnesty program applies to residential or commercial building permits that are submitted after work has already commenced or been completed, which are not associated with a confirmed code enforcement case. It does not apply to zoning violations, building permits that have already been submitted, or building permits that are associated with a confirmed code enforcement case.

 

At the request of the Board, staff has also included with this agenda item the informational packet, flyer, and a copy of the press release that will be sent out.

Do not adopt the Resolution and provide direction to staff.
