Previous Board/Board Committee Actions:

In May 2017, the Mendocino County Board of Supervisors directed the Department of Agriculture to provide Board updates regarding the implementation of the Cannabis Cultivation Program.  On June 20, 2017, the Agriculture Department provided an update on the recently implemented Cannabis Cultivation Program, including initial application numbers.  During the update to the Board on July 11, 2017, the Board directed staff from the Departments of Agriculture, Planning and Building Services, and the Code Enforcement Unit to return on July 18, 2017, to address questions from the board and public comment.  During the update on July 18, 2017, the board received information on many of the items of concern and directed staff to return on August 8, 2017, for further discussion and direction from the Board.  Specific topics to be addressed will include: Possible amendments to the Cannabis Cultivation Ordinance, clarification of issues regarding Americans with Disabilities Act (ADA) for commercial structures from Planning and Building Services and the Environmental Health Department, and potential solutions for streamlining the permitting process. In addition, on July 18, 2017, the Board directed the Executive Office to develop a Cannabis Management Unit.

Since July 18, 2017, representatives from the Executive Office, the Department of Agriculture, Planning and Building Services and Code Enforcement, have been working together to resolve ongoing operational issues within the Cannabis Cultivation Program.  Much progress has been made on identifying those challenging areas and developing options for problem resolution.  Today, the Board of Supervisors will hear about the operational challenges, possible ordinance revisions and give direction to staff.  The Executive Office will provide an update on the operations and the development of a Cannabis Management Unit.  Additionally departments will present on the following items: County Counsel Memorandum regarding the Cannabis Program, Building Memorandum regard agricultural exempt buildings and Environmental Health Memorandum regarding septic system requirements.  During the staff presentations, proposed ordinance amendments will be presented to the Board for consideration and direction.  The purpose of the proposed amendments is for staff to receive clear direction on items to bring back in a revised ordinance for a first reading on August 15, 2017.
